Terms of Engagement Contractual Architecture

Engagement terms define scope before work begins.

Review our legal framework governing client estimates, milestones, intellectual property rights, and commercial deliverables. All projects execute under formal, signed specification agreements.

13 Disclosure Articles // Expandable Format
Article 1: Effective Date and Operational Currency

These Terms of Engagement take effect on 2026-10-30 and supersede all prior unexecuted proposals, oral understandings, and legacy drafts. They establish the operating rules for browsing willobrest.com, submitting project briefs, and transitioning inquiries into binding production contracts.

We review these clauses biannually to align with evolving digital standards in Colorado and international consumer privacy mandates. Your continued access to our platform confirms acceptance of these terms as currently formulated.

Article 2: Contracting Entity and Physical Practice

These terms constitute a legal agreement with Willobrest, trading online at willobrest.com. The practice is registered as an active independent web design and development business in the State of Colorado, operating continuously since 2018.

Our physical studio address is 300 East 17th Avenue, Denver, Colorado 80203, Denver, Colorado, United States. Formal legal notices and physical correspondence must be delivered to this postal address. Electronic communication may be routed to [email protected].

Article 3: Professional Service Scope and Delivery Boundaries

Willobrest Studio provides custom front-end architecture, bespoke website engineering, editorial design systems, and technical consulting. We craft production code utilizing valid semantic HTML5, modern CSS layouts, and vanilla ECMAScript.

We explicitly do not provide generic template modifications, proprietary closed-source site builders, mass-market offshore engineering, or automated marketing bots. All engineering is performed in-house by our principal web designer. Any deliverable outside the written specification ledger requires a formal change order.

Article 4: Inquiry-Only Platform and Estimate Non-Binding Nature

This website is strictly an informational and inquiry destination. There is no shopping cart, no checkout gateway, and no payment processor on willobrest.com. We do not solicit, accept, or process credit card credentials or bank transfers through this public interface.

All cost bands, calculator outputs from fit-checker.html, and catalog figures are non-binding estimates based on typical architectural parameters. An inquiry submitted through foze148.php or nura3a4.php does not constitute an accepted order. A binding commercial agreement occurs solely when both parties countersign a bilateral Master Services Agreement (MSA) containing an itemized Statement of Work and invoice schedule.

Article 5: Commercial Fee Structure and Quote Drivers

All commercial figures are denominated and payable in United States Dollars (USD). Our baseline deliverable bands are established from confirmed operator metrics:

  • — Landing Page: 1500–4000 USD per site
  • — Bespoke Small Website: 2000–8000 USD per site (~5 pages)
  • — Custom Studio Website: 4500–12000 USD per site
  • — Design & UX/UI System: 2000–15000 USD per project
  • — Hourly Technical Direction: 85–185 USD per hour
  • — Ongoing Maintenance & Support: 100 USD per month

A final quote depends specifically on: page count, custom interactive workflows, readiness of client-supplied texts and photography, third-party integrations (CRM, payment, booking APIs), delivery turnaround windows (standard 2–4 weeks versus expedited delivery), and legacy content migration needs.

Article 6: Acceptable Use and Platform Security Standards

Visitors agree to use willobrest.com solely for legitimate commercial inquiry and evaluation. You must not submit automated scripts, crawl payloads designed to disrupt service availability, or attempt unauthorized penetration testing against foze148.php, nura3a4.php, or administrative endpoints.

Injecting malicious payloads, manipulating HTTP request headers, subverting honeypot mechanisms, or sending unsolicited bulk commercial messages (spam) through our inquiry forms is strictly forbidden and constitutes a material breach actionable under Colorado law.

Article 7: Intellectual Property Rights and Work Ownership

All editorial texts, layout designs, typographic hierarchies, vector icons, SVG marks, and photographic assets displayed across willobrest.com are the exclusive intellectual property of Willobrest Studio, protected under United States and international copyright statutes. No portion of this site may be duplicated, adapted, or incorporated into commercial templates without express written authorization.

Upon project completion and receipt of final settlement under a countersigned Statement of Work, clients receive full commercial ownership of all custom front-end markup, client-specific graphics, and bespoke layout code. Willobrest Studio retains perpetual moral authorship and the standard right to showcase finished work within our professional portfolio and case archive.

Article 8: Warranty Disclaimers and As-Is Operation

This website and all preliminary materials are provided on an “as is” and “as available” basis without express or implied warranties of any kind. While we engineer our platforms to adhere to rigorous W3C syntax and WCAG 2.1 AA accessibility guidelines, we do not warrant that server responses will be entirely uninterrupted, error-free, or compatible with obsolete legacy browser engines.

We disclaim all implied warranties of merchantability, fitness for a particular commercial endeavor, and non-infringement to the fullest extent permitted by applicable law.

Article 9: Limitations of Liability and Damage Caps

To the maximum extent permitted under Colorado law, Willobrest Studio, its principal designer, and affiliated contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of, or inability to access, this website.

This includes, without limitation, damages for loss of business revenue, commercial interruption, lost data, or goodwill. In no event shall our total aggregate liability for all claims arising out of website usage exceed the total amount paid by you to Willobrest Studio during the six-month period preceding the claim, or fifty United States Dollars ($50.00 USD), whichever is greater.

Article 10: Termination of Access and Service Suspension

We reserve the right to restrict, suspend, or terminate access to willobrest.com, our interactive fit assessment tool, or real-time support chat at our sole discretion, without prior notice, in the event of suspected abuse, automated scraper intrusions, or breaches of these engagement terms.

All provisions concerning intellectual property ownership, warranty disclaimers, liability caps, and dispute resolution shall survive any such termination.

Article 11: Governing Law and Judicial Jurisdiction

These terms, and any legal dispute or claim arising from or related to the use of willobrest.com, are governed exclusively by the laws of the State of Colorado, United States, without giving effect to any choice of law or conflict principles.

Both parties irrevocably agree that all judicial proceedings, disputes, and hearings shall be conducted exclusively in the state or federal courts situated in Denver, Colorado. You consent to personal jurisdiction and venue in such courts and waive any defense grounded in an inconvenient forum.

Article 12: Notification of Material Modifications

We reserve the right to revise these Terms of Engagement at any time. When modifications occur, we update the Effective Date stamped on Article 1 and archive legacy records at our Denver office. Material amendments affecting ongoing client relationships will be communicated via direct email to active clients.

Your continued navigation of willobrest.com following the publication of revised terms constitutes binding acceptance of the updated conditions.
